1. About Market Share

Market Share is an online grocery and food sourcing platform that offers three core services: (a) regular online grocery shopping with doorstep delivery, (b) a bulk slot purchasing system that allows multiple buyers to share the cost of a large food purchase, and (c) a market errand service where Market Share sources items directly from local markets on behalf of the customer. We currently operate in Abuja (FCT) and Enugu, Nigeria.

2. Eligibility

You must be at least 18 years old to place an order or use our services. By using Market Share, you confirm that you are at least 18 years of age and that all information you provide is accurate and truthful. We reserve the right to refuse service to anyone at our discretion.

3. Orders and Payment

• All orders must be paid in full before fulfilment begins. Market Share does not offer credit or payment on delivery unless explicitly stated.
• Prices are displayed in Nigerian Naira (NGN) and are correct at the time of listing. Market Share reserves the right to update prices to reflect current market rates. You will always see the final price before confirming payment.
• Payment is processed securely via Paystack or Flutterwave. You will receive a payment confirmation via email and SMS upon successful payment.
• Market Share reserves the right to cancel an order if the item is unavailable, if there is a pricing error, or if there is any indication of fraudulent activity. A full refund will be issued in such cases.
• By placing an order you confirm that you are authorised to use the payment method provided.

4. Bulk Buying and the Slot System

• A bulk deal is only triggered and fulfilled once all available slots for that deal have been purchased by buyers.
• If a bulk deal does not reach the required number of slots within the stated listing period, all slot buyers will receive a full refund to their original payment method within two to three business days.
• Once a bulk deal is confirmed, slots have been filled, and Market Share has sourced the bulk item, slot purchases are non-refundable unless there is a verified quality issue with the items received by the buyer.
• Estimated delivery dates shown on bulk deal listings are targets based on typical fulfilment timelines. Actual delivery may vary by one to two business days. Market Share is not liable for minor delays due to sourcing or logistics.
• Items will be measured, weighed, and photographed before dispatch. Market Share guarantees that each buyer receives the exact quantity associated with their purchased slot(s). Any shortfall must be reported within 24 hours of delivery.

5. Market Errand Service

• Market errand requests are fulfilled at current market prices. Market Share does not guarantee fixed prices, as fresh produce and food items fluctuate daily.
• A transparent pricing quote will be sent to the customer before any payment is taken. Market Share will not source or purchase any items until the customer has reviewed and approved the quote.
• A service fee covering sourcing, packing, and delivery will be clearly stated in the quote. This fee is non-refundable once sourcing has begun.
• Same-day delivery for errand requests is available for orders approved and paid before 12:00 noon. Orders submitted after this time will be processed on the next available delivery day.
• If a specific requested item is unavailable at the market, Market Share will notify the customer immediately. No substitutions will be made without explicit customer approval.
• Photo confirmation of sourced items will be sent to the customer via WhatsApp before final packing is completed.

6. Delivery

• Market Share currently delivers within Abuja (FCT) and Enugu. Delivery to locations outside these areas is not available unless explicitly agreed in advance.
• Delivery fees are calculated at checkout based on your delivery address and are shown clearly before payment is confirmed.
• Delivery times are estimates. Market Share is not liable for delays caused by traffic, weather, road closures, or any circumstances beyond our reasonable control.
• It is the customer's responsibility to ensure that someone is available to receive the order at the specified address and time. For fresh and perishable items, Market Share is not responsible for spoilage if the customer was unavailable to receive a timely delivery.
• If a delivery attempt is unsuccessful, our team will contact you by phone to arrange redelivery. Additional delivery fees may apply for redelivery.

7. Product Quality and Freshness

Market Share sources all items from trusted markets and suppliers. We take reasonable care to ensure freshness and quality. However, as fresh produce is perishable by nature, Market Share does not guarantee a minimum shelf life beyond the day of delivery unless stated otherwise for specific items.

If you receive items that are spoiled, rotten, or significantly below quality on arrival, contact us within 24 hours with photos and your order number. We will investigate and offer a replacement or refund as appropriate.

8. Refunds and Cancellations

• If your order is incorrect, incomplete, or contains spoiled items, report the issue within 24 hours of delivery. We will arrange a replacement or refund after reviewing the complaint.
• Refunds are processed within three to five business days to the original payment method.
• Change-of-mind cancellations are not accepted once an order has been sourced, packed, or dispatched for delivery.
• For bulk deals that do not fill, refunds are processed automatically within two to three business days without requiring a customer request.
• If Market Share cancels an order due to stock unavailability or a pricing error, a full refund will be issued within two business days.

9. User Responsibilities

By using Market Share, you agree to:

• Provide accurate, current, and complete information including your name, phone number, and delivery address.
• Not use Market Share for any unlawful, fraudulent, or abusive purpose.
• Not submit false or misleading errand requests or orders.
• Not attempt to manipulate bulk deals by creating multiple accounts to purchase slots.
• Notify us promptly of any changes to your delivery address or contact details that affect an active order.

10. Intellectual Property

All content on the Market Share website — including the name, logo, product descriptions, photography, and copy — is the property of Market Share Ltd. You may not reproduce, distribute, or use any content from this website without prior written permission.

11. Limitation of Liability

Market Share's total liability to you for any claim arising from your use of our services is limited to the value of the order in question. We are not liable for any indirect, incidental, consequential, or special damages, including loss of income, loss of data, or business interruption, arising from your use of Market Share.

Market Share is not responsible for delays, losses, or damages caused by third parties including payment processors, delivery subcontractors, or market suppliers, except where Market Share has been directly negligent.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from your use of Market Share that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Abuja, Nigeria.

13. Changes to These Terms

Market Share reserves the right to update or modify these Terms at any time. When changes are made, the Last Updated date at the top of this page will be revised. Continued use of our platform following any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
